These terms and conditions (“Terms”) govern your use of the King Daka website (“Website”). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Website.

By accessing or using the Website, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not access or use the Website.

2. Eligibility

You must be at least 18 years old to use this Website and participate in our competition. By using this Website, you represent and warrant that you are at least 18 years of age and/or have permission to participate with parental consent. If you are found to be breaking these terms, we reserve the right to withhold any and all prizes and cancel your account.

3. User Account

3.1. In order to access certain features of the Website, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

4.1. You agree to use the Website only for lawful purposes and in accordance with these Terms.

6. Disclaimer of Warranties

6.1. The Website is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied.

6.2. King Daka makes no warranty that the Website will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Website or the server that makes it available are free of viruses or other harmful components.

7. Limitation of Liability

7.1. In no event shall King Daka, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Website; (ii) any conduct or content of any third party on the Website; (iii) any content obtained from the Website; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.

9. Changes to Terms

King Daka reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

11. Prize Draws

We use an online random name picker to draw our winners. The software is provided by Tpal and is compliant with all Governments in Australia. We have no control over the outcome, and it is completely random. We will announce the winner of each of our competitions via our Facebook page and/or via email.

12. Awarding Prizes

If you are drawn as a winner of a major prize, you will be contacted by phone ONLY to double-check your postal address. We will not contact you via Facebook Messenger or email for major prize draws. Do Not respond to any persons pretending to be from King Daka via these mediums. If we cannot get hold of the winner by phone call after ten days, we will draw a new winner.

13. Postage

If you are a winner of one of our prize packs, King Daka will cover all postage costs to your address in Australia. Once it is posted, we have no control over the length of time it will take to arrive and neither do we have control over how the package arrives. If an item is damaged, King Daka can assist you in claiming damages via Australia Post, but we have no control over their outcome or how much damage they will cover.

14. Refunds

We do not offer refunds on the day or after a prize has been drawn. If you have purchased an entry by mistake, you have up to 48 hours before the prize draw closes to request a refund. No other refund shall be offered or honoured. For Physical items purchased from our store, we offer refunds only on defective products.
